Yonkers Police Department Records Section

The Yonkers Police Department Records Section is on the second floor of the Cacace Justice Center at 104 South Broadway, Yonkers, NY 10701. The office is open Monday through Friday, 9 AM to 3 PM, and closed on holidays. You can call the Records Unit at 914-377-7232. The fax number is 914-377-7235.

The Records Section keeps all official police reports, both criminal and non-criminal. They handle the acceptance, recording, and release of reports. They also manage subpoenas for officers and civilian witnesses, process letters of conduct requests, and run voluntary fingerprinting. All incoming and outgoing mail for the police department goes through this office.

To get a copy of a report, visit the Records Unit in person with valid government-issued ID. You must be listed on the report to pick it up. If someone else needs to get your report, they will need a notarized letter of authorization plus their own valid ID. HIPAA authorization forms are not accepted in place of this.

FOIL Requests for Yonkers Police Records

If you are not listed on a report or need records for other reasons, you must file a FOIL request. FOIL stands for Freedom of Information Law. Submit your request through the Yonkers Police Department Records Division. Do not send FOIL requests to the Office of Public Information, as they will not process them.

Under state law, the department must acknowledge your request within five business days. They will either provide the records, deny the request with a written explanation, or give you a date when you can expect a response. The standard fee is $0.25 per page for copies. If a case is currently under open investigation or pending with the District Attorney's Office or court, the records cannot be released.

If your FOIL request is denied, you can appeal in writing within 30 days. The appeal goes to the FOIL appeals officer for the city.

Accident Reports

All motor vehicle accident reports from 2010 forward are only available on CrashDocs.org. You cannot pick them up at the Records Unit or at a local precinct. Reports are typically available within 8 to 10 business days from the date of the accident.

If an information exchange was done on scene, no report will be written. Per New York State Vehicle and Traffic Law, if an accident causes property damage only, the drivers must exchange license, insurance, and registration details on the spot.

For non-motor vehicle accident reports, you can pick them up in person at the Records Unit. You must be on the report. To get copies by mail, send a copy of your government-issued ID, a non-refundable $2 search fee, and a self-addressed stamped envelope to: Yonkers Police Department, Records Unit, 104 South Broadway, Yonkers, NY 10701. Include the incident number, date, location, and type of incident.

Fingerprinting Services

The Yonkers Police Department offers fingerprinting by appointment only. Call 914-377-7232 to schedule. The fee is $50 for Yonkers residents. You need proof of residency along with a valid government-issued photo ID. Non-residents pay $75. Payment is accepted by cash, bank check, or money order.

Fingerprint cards cost $1 each at the Records Unit. The department does not submit fingerprints to any agency on your behalf. You are responsible for sending your prints to the proper agency after they are taken. Bring a passport or state-issued photo ID to your appointment.

Subpoena Processing

For records subpoenas, the subpoena must be "So Ordered" by a judge. Checks should be made payable to "City of Yonkers Police Department." Family Court subpoenas cost $15. Supreme Court subpoenas are also $15. Federal Court subpoenas cost $25.

For officer appearance subpoenas, checks go to the specific officer requested. Small Claims Court costs $15, Supreme Court is $25, and Federal Court is $40.

Yonkers Criminal Court

Yonkers has its own criminal court. It handles misdemeanors and preliminary felony hearings. The Yonkers Criminal Court can be reached at 914-377-6354. The Yonkers Family Court number is 914-831-6525. Felony cases that go to trial are sent to Westchester County Supreme Court.

Westchester County District Attorney

The Yonkers branch of the Westchester County District Attorney can be reached at 914-377-6400. The main branch is at 914-995-3414. The DA's office prosecutes criminal cases from Yonkers. They hold prosecution files and can respond to FOIL requests for their own records. If a case is active, records may be withheld until the case is resolved.

State Criminal History Records

The Division of Criminal Justice Services is the only source of official New York State criminal history records. DCJS uses fingerprint-based records. To get your own record, submit fingerprints through an IdentoGO location. The fee runs $50 to $65. Results come by mail in 7 to 10 business days. DCJS records cannot be obtained through FOIL.

The NYS Office of Court Administration also runs a Criminal History Record Search for $95 per name. This is name-based, not fingerprint-based. It only finds exact matches on name and date of birth. Results cover all 62 counties.

Record Sealing

Arrests that end in a dismissal or acquittal are sealed automatically under CPL 160.50. For conviction sealing, CPL 160.59 allows people with no more than two convictions (one felony max) to apply after 10 years. The Clean Slate Act, effective November 16, 2024, will eventually auto-seal eligible misdemeanors after 3 years and felonies after 8 years. Sex offenses and Class A felonies are not eligible.
